ELECTRIC PICTURES PRIVACY POLICY

Introduction

Your privacy is important to Electric Pictures Pty Ltd (“Electric Pictures” “we” “us” “our” which definition includes our successors, licensees and assigns) and we take our obligations around the collection and use of your personal information very seriously.

We comply with our obligations under the Privacy Act 1998 (Cth), including the Australian Privacy Principles concerning personal information of individuals. 

By providing us with your personal information, you consent to us using and disclosing it for the purposes set out in this privacy policy statement (“Privacy Policy”).

We will update this Privacy Policy when our information handling practices change, or when required. Any updates will be published on the “Electric Pictures Site” being the website owned and operated by Electric Pictures Pty Ltd and located at https://electricpictures.com.au/privacy-policy/ or such other URL as may be designated by Electric Pictures.

We may also issue specific privacy statements relating to particular productions or activities conducted by Electric Pictures e.g. information provided when participating in the production, entering a competition, subscribing to a newsletter, participating in a survey or when using the Electric Pictures Site.

If there is any inconsistency between this Privacy Policy and those specific and additional provisions, the specific and additional provisions will prevail.

Why we collect, use, hold and disclose personal information

The main purposes for which we collect, hold, use and disclose your personal information include:

  • managing and carrying out the business operations, activities and obligations of Electric Pictures;
  • to conduct research, development, production, distribution and promotion of Electric Pictures film or television productions;
  • in connection with the assessment of the suitability of persons applying for employment or engagement with Electric Pictures or to participate in Electric Pictures productions;
  • for marketing communications of Electric Pictures film and television productions; and
  • maintaining records and complying with our legal obligations.

What personal information do we collect

Personal information is information about you that identifies you or that might reasonably identify you, or information about you as an identifiable individual.

The personal information that we collect may include:

  • contact information such as your name, email address, mailing address, phone number and mobile phone number;
  • details from identification documents, including but not limited to your passport and driving licence;
  • payment details such as credit card details and billing addresses;
  • demographic information such as your age, education, gender, interests and postcode;
  • physical characteristics (including photographs);
  • your employment status and/or education, qualifications; and
  • any other information you choose to supply to us or that is otherwise gathered through your use of the Electric Pictures Site.

Other information we may collect and process about you in connection with your use of the Electric Pictures Site includes:

  • Information derived from cookies (small text files placed on our computer which uniquely identify your browser the next time you visit the Electric Pictures Site), save where you disable cookies or otherwise manage them, or do not use any Electric Pictures services which require cookies to be enabled; and
  • Information gathered automatically by our computer systems programmed to gather certain anonymous data to help us understand how the Electric Pictures Site is being used and how we can improve it. This automatically gathered data includes your computer’s IP or “Internet Protocol” address, browser type, browser language, the pages visited, previous or subsequent sites visited, length of user sessions, access status or conditions.

We will only collect Sensitive Information (as that term is defined in the Privacy Act 1988 (Cth) about you if you consent to us collecting that information. Sensitive Information includes information about your racial or ethnic origin, political opinions, professional or political or religious affiliations or memberships, sexual orientation or practices, criminal record, health, genetics and/or biometrics.

We may collect personal information from you:

  • when you make contact with Electric Pictures and disclose personal information to us;
  • when you use the Electric Pictures Site or any services provided by Electric Pictures;
  • when you apply for a role on Electric Pictures’ productions and in the course of carrying out those functions, or providing those services or facilities;
  • when you apply to participate in one of Electric Pictures’ productions in any other way, such as in an on-screen participant, presenter, interviewee, actor or participant in any ancillary content related to a production; or
  • when you are in any way associated with the development, financing, production and marketing of one of Electric Pictures’ productions.

We will generally collect personal information about you from you directly. However, on occasion we may collect personal information about you from third parties, including from:

  • participants in our productions;
  • agents or other representatives;
  • contractors that supply services to our productions; and
  • funding bodies and broadcasters.

How we share or disclose personal information

Electric Pictures will use reasonable endeavours to keep the information we collect from you confidential.

We may disclose the personal information, other information, or data we collect from you as follows:  

  • as set out in this Privacy Policy;
  • for the particular purpose for which the personal information was collected;
  • with your consent;
  • as required or permitted by the law, to cooperate with regulators or law enforcement authorities; or to enforce our Terms of Use or other agreements; or to protect our rights, property or safety of Electric Pictures, our customers or others. The foregoing includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk protection;
  • in the event that Electric Pictures or substantially all of its assets are acquired by or merged with another company, your personal information may become subject to a different privacy policy;
  • with third parties who do analysis and development on our behalf. We may share your information with such a third party provided that such third party uses the information only to perform services as requested by Electric Pictures and agrees to maintain the information as strictly confidential;
  • to send you promotional material, which you may find of interest. If you do not wish to receive any such material, you may simply choose to “unsubscribe” from our mailing lists and no further material will be sent to you.

Without limiting the above, we may disclose personal information where reasonably necessary for us to carry out one or more of our functions or activities, which may include disclosing to:

  • third party service providers, independent contractors or employees engaged by Electric Pictures or our productions;
  • third parties contributing to or associated with the development, financing, production or marketing of Electric Pictures productions including broadcasters, investors and financiers, our insurers, distributors and other goods and service suppliers;
  • government funding departments and agencies;

who may use and disclose such information for the purposes described in this Privacy Policy.

Electric Pictures’ productions may need to provide personal information about you to third parties outside of Australia for the purposes described in this Privacy Policy.

How we store your personal information

The security of your personal information is very important to us. We take reasonable steps to protect your personal information from misuse, loss, unauthorised access, modification or disclosure.

  • Information stored electronically on our emails or servers is protected by data protection protocols including encrypted password protection and restricted access procedures.
  • Electronic information is also backed up on servers located within Australia.
  • Information kept at our offices is protected by a manual and electronic security system for our premises.
  • Our employees and contractors are made aware of Electric Pictures’ obligations to protect personal information and adhere to company protocols which reflect this Privacy Policy and the Australian Privacy Principles.

Our security procedures

Once we receive personal information from you, we take all reasonable steps to ensure that all information we collect, use or disclose is accurate, up to date and stored in a secure environment and accessed only by authorised persons.  Your personal information is password protected from unauthorized access or use whenever such information is stored in our systems.

We require our privacy standards to be observed by external parties who provide services to us and who may come into contact with your information. While we encourage all parties involved to adhere to our privacy standards, we cannot and do not assume any responsibility for any actions or omissions of third parties, including the manner in which they use information received either from Electric Pictures or independently.

How long do we keep your personal information

We will retain your personal information:

  • for as long as it is necessary for our functions or activities; and
  • in some cases, we may be required to retain your personal information to comply with our legal obligations, resolve disputes, and/or enforce our agreements.

Your responsibility

Please note that you play an important and substantial part in protecting the security and confidentiality of your personal information.  Where we have given you (or you have chosen) a password which enables you to access any Electric Pictures service, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

We would advise you that the transmission of information via the internet is not completely secure and may be intercepted or accessed by unauthorized third parties. While we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to any Electric Pictures service; any transmission is at your own risk. It is your responsibility to take all necessary security precautions to ensure the integrity of your computer system, to minimize the risks of third parties gaining unnoticed access to your computer system, and to protect your computer system from viruses and other malicious code.

This Electric Pictures Site may contain links to third party websites which are outside our control. These sites may also collect information about you and use this information according to their privacy practices which may differ from this Privacy Policy. Once you’re outside the Electric Pictures Site, any information you submit is outside of our control.

Amendments

Electric Pictures reserves the right to modify this Privacy Policy at any time. Continued use of the Electric Pictures Site or any Electric Pictures service provided herein signifies acceptance of any such modification.
